Equally important is the question of whether they provide a unique set of regulatory challenges. In the last 18 months, the US Environmental Protection Agency has begun the process of trying to meet the regulatory challenge of nano using the Toxic Substances Control Act (1976)(TSCA). In this central piece of legislation, ‘newness’ is a critical concept. Current EPA policy, we argue, does (...) not adequately (or ethically) deal with the novelty of nano. Dire toute la vérité et rien que la vérité. Vivre dans la transparence et la franchise. Ces préceptes, les chantres du vrai ont voulu les appliquer de force à ce que tout nous désigne comme une forme retorse du mensonge : la littérature. Quelle est la légitimité de cette posture? N'est-on pas amené à la suspecter, à en reconnaître la fragilité et les impasses? Car, examinant l'inlassable guerre qui a opposé les tenants de la sincérité (Rousseau, Leiris, Sartre) à leurs (...) détracteurs (Molière, Laclos, Dostoïevski, Gary, Perec), on aperçoit se profiler une autre définition de ce qu'est la littérature. En toute mauvaise foi : ne serait-ce donc pas ainsi que les oeuvres se présentent à nous et se jouent de nous? C'est-à-dire en s'inscrivant dans une structure qui n'est ni le mensonge ni la vérité, mais leur mélange incertain. Qui affirme en niant et qui dément en proclamant. Sommes-nous pourtant prêts à accepter que tout discours échappe à ce qu'il est tout en continuant de l'être, à admettre que la littérature ne produise qu'une vérité, parfois contradictoire, et non la vérité? Percevoir la manière dont l'oeuvre pose la mauvaise foi, la suscite et la défie, c'est approcher ce qui constitue sa matière même, tant le moteur de ses intrigues que sa métaphysique implicite ou explicite. Mais c'est aussi repenser son rapport au lecteur, au réel et au savoir. Car il y a un paradoxe commun au menteur et au sincère que seule la mauvaise foi permet de décrire en s'arrachant à nos routines intellectuelles. (shrink)

Exode hors de la dogmatique ou de la théologie fondamentale car, là, il y va de connaissance, d'appartenance fidèle, de théologalité. Mais comment déthéologaliser la religion sans la déthéologiser? Comment la (...) penser autrement que comme une expérience humaine du divin, de l'Absolu ou de l'Ultime réel? Le déplacement proposé table moins sur les registres cognitifs ou affectifs investis par les recherches sur le phénomène religieux ou l'option herméneutique du pluralisme religieux que sur un registre de l'agir ou d'une posture éthique marquée d'actes et de paroles. Comment faire travailler la notion de religion en théologie autrement qu'à partir de l'identité, de la mémoire et plus à partir de l'estime de soi? Au moyen d'une lecture du traitement de la vertu de religio et des vices s'y opposant dans la Summa theologice de Thomas d'Aquin. A partir de ce travail de lecture, une structure formelle heuristique de la religion est reconstituée dans la différence et les rapports entre religio, superstitio et irreligiositas. Une catégorie lentement élaborée, " instance éthique advenant en posture subjective ", sous-tend cette diffraction heuristique : sur une " scène de la béatitude ", l'advenir de l'instance éthique se joue dans l'inscription désirée, choisie, réitérée et énoncée pour elle-même d'un mouvement en-vers Dieu. Pour produire ce chemin de réflexion, il aura fallu opérer et proposer une inscription contemporaine d'un discours thomasien dans le champ des discussions théologiques actuelles. (shrink)

The article surveys and analyzes the roles in Judaism of the value of imago Dei/human dignity, especially in bioethical contexts. Two main topics are discussed. The first is a comparative analysis of imago Dei as an anthropological and ethical concept in Jewish and Western thought (Christianity and secular European values). The Jewish tradition highlights the human body and especially its procreative function and external appearance as central to imago Dei. The second is the role of imago Dei as a moral (...) value relative to others. In rabbinic Judaism, respect for human dignity is not the primary moral maxim; it is secondary to the value of neighborly love and sometimes to other moral laws and values. (shrink)

In the present paper, we consider a bio-economic equilibrium model which describes the dynamics of a fish population fished by several fishermen seeking to maximize their profits. Each fisherman tries to find the fishing effort which maximizes his profit at biological equilibrium without any consultation with others, but all of them have to respect two constraints: (1) the sustainable management of the resources ; and (2) the preservation of the biodiversity. The drive for cost-effective use of medical interventions has advantages, but can also be challenging in the context of end-of-life palliative treatments. A quality-adjusted life-year (QALY) provides a common currency to assess the extent of the benefits gained from a variety of interventions in terms of health-related quality of life and survival for the patient. However, since it is in the nature of end-of-life palliative care that the benefits it brings to its patients are of short duration, it fares poorly (...) under a policy of QALY-maximization. Nevertheless, we argue that the goals of palliative care and QALY are not incompatible, and optimal integration of palliative care into the calculation of QALY may reveal a mechanism to modify considerations of how optimal quality of life can be achieved, even in the face of terminal illness. The use of QALYs in resource allocation means that palliative care will always compete with alternative uses of the same money. More research should be conducted to evaluate choices between palliative care and more aggressive therapies for the terminally ill. However, current limited data show that investing in palliative care makes more sense not only ethically, but also financially. (shrink)

Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

Theoretical methods for empirical state determination of entangled two-level systems are analyzed in relation to information theory. We show that hidden variable theories would lead to a Shannon index of correlation between the entangled subsystems which is larger than that predicted by quantum mechanics. Canonical representations which have maximal correlations are treated by the use of Schmidt and Hilbert-Schmidt decomposition of the entangled states, including especially the Bohm singlet state and the GHZ entangled states. This study examines whether truth-telling in the form of honest reporting is associated with cognitive moral development. Conventional agency theory assumes that people are self-interested and willing to tell a lie to increase their personal payoffs, while recent empirical evidence shows that some people give up monetary rewards to tell the truth. The social psychology literature suggests that cognitive moral development influences individuals’ ethical decisions. We carried out an experiment whereby participants submitted managerial reports in which truth-telling decreased their monetary (...) payoff. Despite the fact that their decisions were not subject to monitoring, auditing, or reputation effects, some participants reported honestly or partially honestly. We find the relationship between honest reporting and cognitive moral development to be both positive and linear. Compared with those at lower stages of cognitive moral development, participants at higher stages of cognitive moral development were more likely to submit an honest report and give up potential monetary gains from lying. We further examine the economic impact of honest reporting on the firm’s profit. With the assumption of self-interest and profit maximization, Antle and Eppen suggest that a contract with a hurdle-rate feature reduces managers’ information rent. We find that in comparison with the expected outcome of a hurdle contract, the firm can yield higher profits with a trust contract by hiring managers with a P-score higher than 16.67. (shrink)

Friends of Wright-entitlement cannot appeal to direct epistemic consequentialism (believe or accept what maximizes expected epistemic value) in order to account for the epistemic rationality of accepting Wright-entitled propositions. The tenability of direct consequentialism is undermined by the “Truth Fairy”: a powerful being who offers you great epistemic reward (in terms of true beliefs) if you accept a proposition p for which you have evidence neither for nor against. However, this chapter argues that a form of indirect epistemic consequentialism seems (...) promising as a way to deal with the Truth Fairy problem. The relevant form of indirect consequentialism accommodates evidentialism but allows for exceptions in the case of anti-sceptical hypotheses. Since these are the kind of propositions to which Wright-entitlement is supposed to apply—i.e. cornerstone propositions—indirect consequentialism is entitlement-friendly. (shrink)

Many patients believe that cardiopulmonary resuscitation is more likely to be successful than it really is in clinical practice. Even when working with accurate information, some nevertheless remain resolute in demanding maximal treatment. They maintain that even if survival after cardiac arrest with CPR is extremely low, the fact remains that it is still greater than the probability of survival after cardiac arrest without CPR. Without realising it, this line of reasoning is strikingly similar to Pascal’s Wager, a Renaissance-era argument (...) for accepting the proposition for God’s existence. But while the original argument is quite logical—if not universally compelling—the modern variant makes several erroneous assumptions. The authors here present a case of a patient who unwittingly appeals to Pascal’s Wager to explain his request for maximal treatment, in order to highlight the crucial divergences from the original Wager. In understanding the faulty assumptions inherent in the application of Pascal’s Wager to code status decisions—and identifying the underlying motivations which the Wager serves to confirm—providers can better ensure that the true values and preferences of patients are upheld. Consequentialist views have traditionally taken a maximizing form, requiring agents to bring about the very best outcome that they can. But this maximizing function may be questioned. Satisficing views instead allow agents to bring about any outcome that exceeds a satisfactory threshold or qualifies as “good enough.” Scalar consequentialism, by contrast, eschews moral requirements altogether, instead evaluating acts in purely comparative terms, i.e., as better or worse than their alternatives. After surveying the main considerations for and against each of these (...) three views, I argue that the core insights of each are not (despite appearances) in conflict. Consequentialists should be deontic pluralists and accept a maximizing account of the ought of most reason, a satisficing account of obligation, and a scalar account of the weight of reasons. We give several characterizations of Schnorr trivial sets, including a new lowness notion for Schnorr triviality based on truth-table reducibility. These characterizations allow us to see not only that some natural classes of sets, including maximal sets, are composed entirely of Schnorr trivials, but also that the Schnorr trivial sets form an ideal in the truth-table degrees but not the weak truth-table degrees. This answers a question of Downey, Griffiths and LaForte.

Advance health care directives and informed consent remain the cornerstones of patients' right to self-determination regarding medical care and preferences at the end-of-life. However, the effectiveness and clinical applicability of advance health care directives to decision-making on the use of life support systems at the end-of-life is questionable. The Uniform Anatomical Gift Act (UAGA) has been revised in 2006 to permit the use of life support systems at or near death for the purpose of maximizing procurement opportunities of organs medically (...) suitable for transplantation. Some states have enacted the Revised UAGA (2006) and a few of those have included amendments while attempting to preserve the uniformity of the revised Act. Other states have introduced the Revised UAGA (2006) for legislation and remaining states are likely to follow soon. (shrink)

Nanotechnology shows great promise in a variety of applications with attractive economic and societal benefits. However, societal issues associated with nanotechnology are still a concern to the general public. While numerous technological advancements in nanotechnology have been achieved over the past decade, research into the broader societal issues of nanotechnology is still in its early phases. Based on the data from the Web of Science database, we applied the main path analysis, cluster analysis and text mining tools to explore the (...) main research fronts and hierarchical structure of these societal issues. We found that the research studies fell into four categories: "General Toxicity and EHS (Environment, Health and Safety)," "Medicine and Cytotoxicity," "Assessment and Regulation," and "Environment and Ecotoxicity." These research studies have disclosed much information about the potential effect of nanotechnology on public health and the environment. Relatively speaking, the studies on the assessment, regulation, preventive solutions, and environmental protection are just emerging. This finding indicates that an abundance of effort should be conducted on these emerging themes to maximize the benefits of nanotechnology while minimizing its potential harm. The implications for various parties in this domain are also presented. (shrink)

OBJECTIVES: In treating critically ill neonates, situations occasionally arise in which aggressive medical treatment prolongs the inevitable death rather than prolonging life. Decisions as to limitation of neonatal medical intervention remain controversial and the primary responsibility of the generally unprepared family. This research was designed to study response patterns of expectant mothers towards treatment of critically ill and/or malformed infants. DESIGN/SETTING: Attitudes were studied via comprehensive questionnaires divided into three sections: 1-Sociodemographic data and prior personal experience with perinatal problems; 2-Theoretical (...) philosophical principles used in making medical ethical decisions; and 3-Hypothetical case scenarios with choices of treatment options. SUBJECTS AND RESULTS: Six hundred and fifty pregnant women were studied. Maternal birthplace (p = 0.005) and level of religious observance (p = 0.02) were strongly associated with the desire for maximally aggressive medical intervention in the hypothetical case scenario. Specific personal experiences such as infertility problems, previous children with serious mental or physical problems were not correlated with the selection of different treatment choices. Of the theoretical principles studied, only the desire to preserve life at all costs was significantly associated with the choice for maximal medical treatment (p = 0.003). CONCLUSIONS: Maternal ethnocultural background and philosophical principles more profoundly influenced medical ethical decision-making than did specific personal life experiences. (shrink)

We propose a generalization of expected utility that we call generalized EU (GEU), where a decision maker’s beliefs are represented by plausibility measures and the decision maker’s tastes are represented by general (i.e., not necessarily real-valued) utility functions. We show that every agent, “rational” or not, can be modeled as a GEU maximizer. We then show that we can customize GEU by selectively imposing just the constraints we want. Organ donation after cessation of circulation and respiration, both controlled and uncontrolled, has been proposed by the Institute of Medicine as a way to increase opportunities for organ procurement. Despite claims to the contrary, both forms of controlled and uncontrolled donation after cardiac death raise significant ethical and legal issues. Identified causes for concern include absence of agreement on criteria for the declaration of death, nonexistence of universal guidelines for duration before stopping resuscitation efforts and techniques, and assumption of presumed (...) intent to donate for the purpose of initiating temporary organ-preservation interventions when no expressed consent to donate is present. From a legal point of view, not having scientifically valid criteria of cessation of circulation and respiration for declaring death could lead to a conclusion that organ procurement itself is the proximate cause of death. Although the revised Uniform Anatomical Gift Act of 2006 provides broad immunity to those involved in organ-procurement activities, courts have yet to provide an opinion on whether persons can be held liable for injuries arising from the determination of death itself. Preserving organs in uncontrolled donation after cardiac death requires the administration of life-support systems such as extracorporeal membrane oxygenation. These life-support systems can lead to return of signs of life that, in turn, have to be deliberately suppressed by the administration of pharmacological agents. Finally, allowing temporary organ-preservation interventions without expressed consent is inherently a violation of the principle of respect for a person's autonomy. Proponents of organ donation from uncontrolled donation after cardiac death, on the other hand, claim that these nonconsensual interventions enhance respect for autonomy by allowing people, through surrogate decision making, to execute their right to donate organs. However, the lack of transparency and the absence of protection of individual autonomy, for the sake of maximizing procurement opportunities, have placed the current organ-donation system of opting-in in great jeopardy. Equally as important, current policies enabling and enhancing organ procurement practices, pose challenges to the constitutional rights of individuals in a pluralistic society as these policies are founded on flawed medical standards for declaring death. In this article we consider the collection of all cardinalities of infinite maximal independent subsets of a BA A ; we call this set the spectrum of infinite maximal independent subsets , denoted by Spind. Note that infinite maximal independent subsets exist in any BA which is not superatomic. The main result is that any set of infinite cardinals can occur as Spind for some infinite BA A . Beyond this we give results concerning the way that Spind changes under various algebraic operations. However, the basic components of most algebras that we deal with are free algebras. (shrink)

The term “pragmatism” has been used and abused by doctrines that are even contradictory among them. For the founder of Pragmatism as a philosophical tradition, Charles Peirce, this situation might seem a sad misunderstanding, and that is why he came up with the term “pragmaticism” in order to distinguish his own particular version of Pragmatism. However, Peirce himself did not leave a systematic treaty that explained what kind of specific conditions distinguish his pragmatism from other versions. In this essay I (...) introduce some criteria that I deem fundamental to disambiguate the meaning of Pragmatism: the use of the logical principle known as the ‘pragmatic maxim’, upon which the corner stone of the tradition should rest; the need to adopt Scholastic Realism and reject Nominalism; and, the operationalist character of Peirce’s pragmatism. In addition, I offer some views avowing that in spite of the differences and distinctions that these criteria establish, there is a core of convergence between the different kinds of pragmatisms present in the philosophical tradition. In this work I argue for the thesis that Grice’s intentional-cooperative analysis of assertion works at three levels: the logical, the epistemological and the normative. I use “conventional implicature” as example. First part shows that other approaches to assertion can’t give an accurate description of semantic content. I point to a general, twofold conclusion: the truth-conditional approach fails by neglecting intentional acts to be the meaning blocks; the rule-oriented approach misses its target by disregarding that all communicative acts are intentional, (...) but many are not conventional. Assertion includes some features of intentional action, the main theme in second part. As rational justification is the basis of intention, the solution of some remaining problems connected to assertion may rest in the justificatory structures underlying intention. Judgment, the epistemic variety of rational acceptability, determines, on one hand, the infelicity in conventional implicature cancellation and, on the other, shows why convention is just a minor component in the theory of meaning. Justification deems a special methodology in which causal explanations of meaning and representation can be replaced by justifications, teleological in character. The rationalist background of Grice’s proposal is thus stressed, as well as his conception of rationality as the body of capacities in charge of identifying and attributing value. Following this interpretation, other problems on meaning and communication, for example the relations between the Cooperative Principle and the conversational maxims, can be dealt with. (shrink)

Economic Theory normally assumes the so-called homo economicus, a consequential model of rationality. We highlight the main features of this model in opposition to deontology: axiological homogeneity, maximization and agent neutrality. Amartya Sen’s criticism of standard consequentialism copes to those features, and includes commitment and duty in the economic rationality. We analyze his concept of preference to ascertain how far economic rationality can thus go in the direction of deontology. We conclude that, though diminished, the difference between them still remains.

Science and engineering remain male-dominated professions in Canada and elsewhere. This is a disheartening fact for a society dedicated to providing equality of education and opportunity, and protection of the right to physical and psychological security of the person to all its citizens. Canadian women comprise 51% of the population, yet still hold down, on average, less than 10% of all jobs in the basic and applied sciences. Few women are found in the upper strata of the science hierarchy, whether (...) judged by income, by rank within the relevant professions, or by inclusion in the structures of government, industry, education or professional institutions which formulate science policy. The evidence is compelling that science as both power and knowledge is firmly located in white, Western, bourgeois, (compulsorily heterosexual) men's hands. (shrink)

In this article I show that the argument in John Harris's famous "Survival Lottery" paper cannot be right. Even if we grant Harris's assumptions—of the justifiability of such a lottery, the correctness of maximizing consequentialism, the indistinguishability between killing and letting die, the practical and political feasibility of such a scheme—the argument still will not yield the conclusion that Harris wants. On his own terms, the medically needy should be less favored (and more vulnerable to being killed), than Harris suggests.

In this paper I tried to find a harm based solution to the non-identity problem. I explore the view upon which future persons are harmed if we prevent them from having what it is required by the Principle of Utility.

Resumen. El presente estudio de caso expone, a partir de la historia de vida como fuente de información, un abordaje de la vida cotidiana más allá de lo meramente narrativo y periodístico. La investigación toma como objeto de estudio los cambios ocurridos en las costumbres y los hábitos de comportamiento cotidiano de una inmigrante española en la colonia agrícola de Turén en Venezuela a mediados del siglo pasado. Se considera que los procesos migratorios, máxime si se enmarcan dentro de un (...) proyecto colonizador, resultan propicios para detectar las variaciones en los mun-dos vitales de las personas, en ese proceso obligado al que se enfrenta el emigrante de ajustarse a las condiciones de un medio ambiente nuevo, extraño y a veces per-cibido como hostil. La información se recoge a través de los recuerdos que tiene la emigrante, suministrados en entrevistas abiertas. Las experiencias de la vida cotidiana en el pueblo español donde vivía la emigrante se comparan con las de la colonia agrícola venezolana a la que fue a vivir, a la luz de aportes teóricos provenien-tes del campo de la antropología. Se concluye que el enfoque etnohistórico de los hechos puede contribuir a explicar el análisis histórico de los mismos, dando una visión alternativa pero complementaria y enriquecedora a las metodologías tradi-cionales para el estudio del pasado. The essay exposes a study of the daily life, trying to overcome the normal, journalis-tic narrative explanations, offering instead an approach based on the history of life-time. The research takes as object of study the expected changes occurred in the personal manners and daily habits of a Spanish immigrant in the agricultural colony of Turen in Venezuela, during the middle of the past century. Migration processes, especially if happen as part of colonization projects, offer a good opportunity to detect relevant changes in the inner lives of people, due to the efforts of the immi-grant to deal with the adaptation to a new, different and sometimes hostile environ-ment. Information is obtained through the remembrances of the immigrant during open interviews. Personal remembrances about her daily life in the small Spanish town where she lived before migration are compared with those other ones in the Venezuelan agricultural colony where she arrived. These comparisons are analysed based on contributions coming from the anthropology field. As a conclusion, etno-history approach is recommended for the study of the past in order to enrich tradi-tional methodologies used by historians, as a complementary approach. Existen tres grandes estrategias para intentar combinar realismo y antirrealismo: una distinción de niveles, una distinción de aspectos y una distinción de partes. En el trabajo se analizan estas tres estrategias. La primera de ellas ha sido desarrollada por numerosos autores. Comentamos en detalle los planteamientos recientes de José Zalabardo a propósito de ciertas tesis de John McDowell, Crispin Wright y Wittgenstein. Esta estrategia plantea graves dificultades. la segunda estrategia parece poder escapar a ellas. Sin embargo, no puede ser adoptada (...) en un sentido máximamente general. Proponemos una combinación basada en la tercera estrategia. Realismo y antirrealismo podrían combinarse de una manera muy natural cuando son adoptados en un sentido local. There are three main strategies to try to combine realism and anti-realism: a distinction of levels, a distinction of aspects, and a distinction of parts. In the paper, these strategies are analysed. The first one has been elaborated by many authors. We discuss in detail the approach of José Zalabardo concerning some theses of John McDowell, Crispin Wright and Wittgenstein. This strategy entails important problems. The second strategy seems to be capable of offering a way out of them. However, it cannot be adopted in a maximally general sense. We argue for a combination based on the third strategy. Realism and anti-realism can be combined in a very natural way when they are adopted in a local sense. (shrink)

En el presente artículo, se examinan y discuten dos argumentos con consecuencias reduccionistas debidos a Jaegwon Kim y a Theodore Sider respectivamente. De acuerdo con el argumento de Kim, la superveniencia fuerte implicaría la coexistencia necesaria de propiedades (es decir, tal y como normalmente se interpreta, la reducción). De acuerdo con el de Sider, ocurriría lo mismo con la superveniencia global. Uno y otro hacen un uso esencial de sendas nociones de propiedad maximal, las cuales son discutidas aquí a la (...) luz de una interpretación natural e interesante de la teoría de las propiedades implícita en sus argumentos. Bajo esta nueva interpretación, en términos modelo-teóricos (véase apartado 4), obtenemos diversas posibilidades de relaciones formales entre las tesis de supervivencia y la reducción, según la lógica utilizada. Al menos bajo una interpretación interesante, los argumentos de Kim y Sider no son correctos, quedando demostrado así que dichos argumentos no son válidos en general. (shrink)

Since its beginnings, the conceptualisation of social responsibility has taken many forms, some of them related to philanthropy, patronage, strategy or business marketing among others. This paper defends the thesis that economic organization needs to manage those communicative goods, such as trust, reputation or reciprocity, evolved in the right development of their business activity and, therefore, on economic profit maximization. But for this, economic organization should implement a social responsibility to live up to expectations at stake; that is, to take (...) into account the ethical dimension that underlies it. RESUMEN: Giving Reasons pretende ofrecer una aproximación no solo precisa, sino comprensiva, a una teoría sistemática de la argumentación. A la luz de una distinción de Vaz Ferreira entre «pensar por sistemas» y «pensar por ideas a tener en cuenta», me gustaría hacer unas observaciones para complementar y, digamos, “abrir” la incipiente clausura teórica del sistema lingüístico-pragmático de Giving Reasons. Voy a considerar dos casos en particular: el tratamiento del concepto mismo de argumentación y la conversión del principio de cooperación (...) y las máximas de Grice en una especie de marco sistemático donde cabe encajar y acomodar el estudio de las falacias.ABSTRACT: Giving Reasons aims to provide an approach not only accurate, but comprehensive, to a systematic theory of argumentation. In the light of a distinction made by Vaz Ferreira between «thinking through systems» and «thinking through ideas to be taken into account», I would like to make some comments in order to provide a certain balance and somehow “open” the inchoative theoretical closure of the linguistic-pragmatic system offered in Giving Reasons. I am going to consider two cases in particular: the treatment of the very concept of argumentation and the transformation of Grice’s Cooperative principle and Maxims into a sort of systematic framework to be applied to the study of fallacies. During the Zimbabwean crisis, millions crossed through the apartheid-era border fence, searching for ways to make ends meet. Maxim Bolt explores the lives of Zimbabwean migrant labourers, of settled black farm workers and their dependants, and of white farmers and managers, as they intersect on the border between Zimbabwe and South Africa. Focusing on one farm, this book investigates the role of a hub of wage labour in a place of crisis. A close ethnographic study, it addresses the complex, (...) shifting labour and life conditions in northern South Africa's agricultural borderlands. Underlying these challenges are the Zimbabwean political and economic crisis of the 2000s and the intensified pressures on commercial agriculture in South Africa following market liberalization and post-apartheid land reform. But, amidst uncertainty, farmers and farm workers strive for stability. The farms on South Africa's margins are centers of gravity, islands of residential labour in a sea of informal arrangements. This paper argues that a principle manner in which Spanish philosopher José Ortega y Gasset’s historicist maxim ’man has no nature, what he has is history’ can be understood is through a pragmatist basis of anti-dualism, in part inherited from American philosopher John Dewey. The thesis here is that it is not that man has no nature, per se, rather that history is his nature because the two are anti-dualistic concepts; history is our nature because it is comprised of, (...) as famously posited by Ortega, “myself and my circumstance”. Hence, neither philosopher negates that “preparedness”, or “nature”, influences our being and behavior, rather they are arguing, more importantly, that “plasticity”, or nurture, plays a greater role given that this encompasses “nature” when we relate Ortega’s application of “history” to Dewey’s use of “experience”. Our “experiences” create our history, and interpretations as to the nature of them are not only potentially infinite, but they are primarily just that - interpretations, which can also change over time. Hence what we truly are is our history. Although these two philosophers are not frequently linked, there is a clear connection in this basic, Deweyen pragmatist anti-dualism as an elder of Ortega. And even though Dewey, unlike Ortega, wrote little on specifically the discipline of history, much of it was indeed fundamentally historical. (shrink)

In an ideal democracy, people from all walks of life would come together to talk meaningfully and respectfully about politics. But we do not live in an ideal democracy. In contemporary democracies, which are marked by deep social divisions, different groups for the most part avoid talking to each other. And when they do talk to each other, their speech often seems to be little more than a vehicle for rage, hatred, and deception. -/- Democratic Speech in Divided Times argues (...) that we should nevertheless not give up on the ideal of democratic public speech. Drawing on the resources of political theory, epistemology, and philosophy of language, this book develops a sustained account of the norms that should govern public discourse in deeply divided circumstances. Should we try to find common ground when we talk to our political opponents, even though they seem unreasonable? Should we refrain from expressing anger, if we want to get things done? How can we use our speech to fight hate speech and disinformation? And is it even possible to speak to 'the other side,' in settings where different groups dislike one another, live apart from one another, and don't know much about one another? By tackling these questions, Lepoutre demonstrates that, when governed by the right set of norms, public speech can be a powerful force for good even amidst profound social divisions. (shrink)
